1. Scope
This Acceptable Use Policy ("AUP") applies to all use of the Backstory Analytics service (the "Service") and is incorporated by reference into our Terms of Service. Breach of this AUP is a breach of the Terms and may result in suspension or termination.
2. Permitted use
You may use the Service only for lawful website analytics purposes, on websites you own or are authorized to track, and in compliance with applicable law and this AUP.
3. Prohibited uses
You agree not to use the Service to:
- Track websites you do not own or do not have written permission to track.
- Collect or attempt to collect personal information about individual website visitors beyond what the Service is designed to do (company-level, pseudonymous session correlation) — see our Privacy Policy.
- Track sensitive personal data (health, financial, political, religious, sexual orientation, etc.) or data about children, without appropriate lawful basis and safeguards.
- Violate any applicable law, regulation, or third party's rights, including privacy and data-protection law in the jurisdictions your website visitors are located in.
- Attempt to de-anonymize, re-identify, or link Backstory's pseudonymous session data to a specific individual.
- Interfere with, damage, disable, or overburden the Service or attempt unauthorized access to it or related systems.
- Reverse engineer, decompile, or disassemble the Service, or circumvent its rate limits or entitlement gates.
- Scrape or extract data from the Service using automated means outside the documented API.
- Resell, sublicense, or redistribute the Service, or use it to build a competing product.
- Transmit malware or other harmful code, or use the Service in furtherance of fraud, phishing, or deceptive practices.
- Use the optional Contacts add-on to send unlawful unsolicited communications, or in a jurisdiction/manner inconsistent with the Leads DPA and applicable anti-spam law (e.g. Australia's Spam Act 2003, the EU's ePrivacy Directive, or the US CAN-SPAM Act).
4. Your responsibilities
You are solely responsible for: obtaining any consents required for data collection on your own website(s) beyond what the Service handles; providing your own visitors with an accurate privacy notice; complying with data-protection law applicable to your business (GDPR, UK GDPR, the Privacy Act, CCPA/CPRA, etc.); and the content and operation of your website(s).
5. Enforcement
We may investigate suspected violations and may suspend or terminate access for breach of this AUP, with or without notice depending on severity. Report suspected abuse to legal@trybackstory.com.
